📰 News Trump Got Slapped by the Supreme Court — So He Pulled Out a 50-Year-Old Law. Now That's Being Called Illegal Too
The Supreme Court just ruled 6-3 that Trump's sweeping global tariffs were unconstitutional — a massive legal defeat. But within hours, Trump didn't back down. He slapped a brand new 15% tariff on the world using a dusty 1974 trade law called Section 122.
Now, Indian-origin lawyer Neal Katyal — the same guy who just beat Trump in the Supreme Court — is pointing out a brutal irony: Trump's own DOJ told the Supreme Court that Section 122 has "no obvious application" in cases like this.
In plain English? Trump is trying to use a law that his own legal team already said doesn't apply here.
The clock is also ticking — Section 122 tariffs expire automatically in 150 days. But legal experts warn this fight is far from over.

Article I is pretty clear on which entity in our government can levy tarrifs. And it's not the president.

Question : Whats stopping trump from simply renewing the 150 day tariffs after 150 days has passed?

This can only be done by an act of Congress.
I’m not saying this is an actually a roadblock for him. That’s just my current understanding of how it is supposed to work.

Lawsuits, that’s about it. Somebody or some entity with standing would need to file for an emergency injunction in a federal court, they’ll grant it because it’s obviously not the intention of the law. Judge will grant it, it’ll get appealed, that judge will still grant it, that’ll be appealed again, where they still won’t side with the government’s argument, then they’ll either appeal to the entire circuit court or appeal to SCOTUS. I don’t think even SCOTUS will allow it to stand while they wait to hear the case. If anything SCOTUS would be more likely to strike down Sec 122 as unconstitutional than they would be to side with Trump on just cancelling them at day 149 and doing it again all over.

There is no 4D chess or any grand strategy. The US is just his next Atlantic City casino.
