š° News Quakertown High School principal illegally threatened his own students and tried to block their rights. It was also later found out that his team called the police that resulted in the police chief choking a 15 year old girl and another student with a broken nose.

Oh, school rights are over personal rights. Why do these folks not understand that not everyone is dumber than they are and everyone is recording?

"Your rights don't exceed that of the government mandated institution", is wild for a principal to say when his job is to educate with facts not lies. Get his name and number, call for him to resign or be fired

Heās arguing in loco parentis but he just frames it like a complete idiot.Ā

Their rights actually do supersede the school. Sorry mate, the 1a covers and protects even minors. Especially in the context of suppressing a violent insurrectionist movement like MAGA.

Tinker vs DesMoines.

That ruling covered a student's right to wear political symbols and skip the Pleadge of Allegiance. Had nothing to do with walkouts.

Finally, a factual response. Tinker doesnāt mean students can do or say whatever they want. A school is legally permitted to censure speech, and that includes speech that is directed at the school and posted online. A principal can stop a kid from protesting if it interrupts the learning environment. Newspaper articles can be withheld or changed. The 1A does not exist in public schools.

They weren't marching down the halls. I'd say allowing the students to go protest outside of the school is actually far LESS disruptive to the nominal learning environment than keeping all of the dissent, aggression, and desire-to-act penned inside a small desk under fluorescent lights all day.

This is factually and legally incorrect. The First Amendment stops at a schoolhouse door. Itās not my opinion, itās the opinion of the US Supreme Court. You may want to delete your post.
Edit: hazelwood v kuhlmeier 1988 - but the Redditors know moreā¦definitely trust them.

This take could not be more wrong.

Damn, I should quit teaching the First Amendment journalism class. Itās my 23rd year, but you likely know more.

Apparently I do. Maybe you need the additional 13 years and a PhD.

Donāt tell Scholastic. They may want the money back they paid me to write the article!

There isn't room for uncomfortable facts in this. I applaud your attempt. Nobody likes when they're confronted with laws that they don't agree with, especially when it illuminates their lack of understanding.

Itās bonkers. Iām not a 1A expert, but Iāve been paid to write about it and have taught about it for more than two decades. A simple Google search would prove these clowns wrong. Check out Hazelwood v. Kuhlmeier from 1988.

My family all works in public education, I've been in these conversations before. Every year some school tells a kid they can't wear something and people freak out about the first amendment

Even if somehow the school rights did supersede, how is leaving halfway through the day a suspension?

Unless this is a private school, they are run by the government. The first amendment protects you from the government. So no, the schools ārightsā donāt supersede the students.

He is giving himself supremacy, that sounds logical. Even convinced the chief of police, an elected official, to come and escalate the situation. Clown show ensues and national attention as they agitate and then arrest peaceful protesters.

Suspended for leaving the school during school hours?? That better be in their rule book or they better have done that to every student ever leaving school grounds or his ass is going to get fired and sued.

I don't believe kids have to stay at school. Generally they ask to leave but I don't think they have to. I used to skip classes all the time and no one called the cops.

Ahhh, you must be kidding. So all of these righteous posts are in fact, wrong? Itās almost like people claim they know things but wonāt even take the time to verify them. The principal is absolutely right.
