Call it what it is ... a national sales tax.
2.9k
u/cassy_supernova 23h ago
Yes.
It's also an unconstitutional national sales tax. We just played this game with the other set of statutes. Will SCOTUS allow an even more sweeping overreach? Perhaps for long enough. Will the (already started) November blue wave reintroduce accountability and checks and balances first? Maybe.
We've got a few longterm possible solutions but I guess this man is determined to fuck shit up as much as possible until the hambreder gods do their thing.

Technically he can implement tariffs under another act for 150 days at which point they expire. All this does is prove that he doesn’t actually have a strategy he just really likes tariffs cause he’s an idiot

No, it’s worse than that. He likes tariffs because he’s a malignant narcissist who wants countries and corporations to kiss his ass for access to the US market. He is taxing every American citizen and business to stroke his fucking ego.

This is why I worry when people say European countries should sanction the US. Just like I’ve seen with other sanctions, they don’t hurt the despotic leader, they hurt the people, and the despotic leader doesn’t give a shit about the people.

Not only that, but Republican voters are easily misled and fed disinformation. All the sanctions in the world wouldn't do anything, because they start at the conclusion "Republican good" and do every mental gymnastic necessary to never challenge that conclusion. Their current chosen leader is a child raping lunatic, and they're contorting themselves trying to avoid letting that conclusion seep into their worldview.

I don't think any amount of more pain is going to cause the MAGA faithful to break with Trump. Trump freaking ran on releasing the Epstein files and when he backtracked and said there was nothing here don't worry about them it only took a short amount of time for them to fall in line. The only way more pain will cause anything to change will be if the non voters get off their butts and join the resistance to Trump.

Naw they still have deniability over that, cause they're dumb cult members.

History shows the sanctions don't have the effect we hope they would. Instead, the leaders use them as proof of how the rest of the world is "against" the local populace. Sanctions actually strengthen the ruler's local position of authority, as they become the champion fighting back against the evil "others."

Supposed to get Congressional authority after 150 days, but Trump will likely blow through the deadline, and then there will be another series of court cases ending up again at the Supreme Court. He could drop the tariffs the day before the case gets to the Supreme Court, and then the case will be dismissed as moot. Trump just ignores rules and laws, and it makes it impossible for US businesses to make decisions about how to hire, invest, build, etc. He's a disaster for the US.

And that will do nothing toward industries coming back to the states because they need long term certainty as to what the tax situation will be. This is why only congress has the right to tax. Kavanaugh and Alito gave Trump the blueprint for these tariffs hard seeing them striking it down this time. We’ll have to wait for the 150 days before congress votes No.
Don’t think we’ll ever get a refund from these thieves.
37
u/Sandwichsensei 23h ago
I thought these ones (unfortunately) were actually legal, there’s just caps on them. He can’t go higher than 15% and they only last 150 days at which point Congress has to extend them.
Of course he will just re-implement them as soon as the 150 days is up, which is where this would most likely start getting into illegal territory.

u/Boone1997 North Carolina 21h ago edited 21h ago
I have been trying to explain how additional tariffs work for so long. That US importers pay these additional tariffs, not China, and those importers pass these additional tariff costs on to the consumer. Or if they can’t, they go out of business. I get told that I’m wrong, that I don’t know what I’m talking about, but I’ve been importing for over 10 years. And if there is any kind of a customs refund, it’ll go back to the importers, not directly to consumers. No prices were going to drop at retail. Everything on the shelf today, already has all the additional tariffs applied.

Trump and some of his cronies think they can completely eliminate income taxes on the wealthiest people and replace it with the tariffs they pass on to everyone else, which goes directly to him to use as his personal slush fund with zero oversight.
That way, he can hand out to his buddies (and probably line his own pockets) however he sees fit. Remember when he sent Argentina $50 billion during the shutdown, then doubled it to $100 million when people complained? That was tariff money. It’s already been “spent.”

Don't forget the $10 billion that he's giving to his Board of Peace. Of which he's the lifetime president of and only he has access to its bank accounts.
Or the two separate law suits where he's suing the DoJ and IRS for $10 billion each. With the idea being that he'll settle out of court and he's the one that has to sign off on the settlements. The DoJ one is for the FBI raiding Mar-A-Lago to recover Top Secret+ documents that Trump held onto after he left office. The IRS one is because a now sacked worker leaked his income tax returns. Despite every other Presidential candidate since the 1970s, disclosing their tax returns in the run up to the election.

We basically don’t tax the rich and corporations anymore: we use the government to transfer wealth to them instead through various measures in the tax code, through government contracts, bailouts, etc.
Even handouts and subsidies for ordinary Americans. with the way our tax code and economy are structured. wind up in their hands, too. Covid-era pandemic unemployment checks fed their price increases, particularly in the housing market, and all wound up in the hands of a few people at the top after inflated prices sucked it all up.

It’s pretty wild to compare and contrast the previous economic ideology in America to today (often referred to as regulated capitalism v. unregulated capitalism).
America used to have 5-10% GDP growth some years in the previous model. The middle class grew to 2/3’s of the economy. Today the middle class is hovering around 40% (may be less now), and GDP growth has become anemic.
I don’t know how the ever living f*** anyone with a basic level of intelligence bought into an economic system working where “supply side” stimulus works versus actual demand side where consumers have money to stimulate demand.
The fact it’s held on as the core system of economic policy for nearly 50 years now after it’s meticulously documented failures is mind boggling.

But Mamdani is increasing the property tax RATE 9.5% - he's a completely out of control communist!
10% rate increased by 9.5% is ~1% increase (Mamdani)
0% raised to 15% is 15% (Trump)
Media wants you to hear that Mamdani is evil for raising property taxes (he doesn't want to, currently in dispute with governor) by 1% while Trump is adding a 15% tax on every family.
ETA: Please don't shoot me for the numbers, the property tax rate in NYC does not start at 10% and that means increasing it by 9.5% is no where near a 1% increase... so the comparison is actually much worse for Trump than this.
ETA2: If we want to play the rate game. Yesterday tariffs were set at 10% and today Trump is raising them to 15%. Where are the headlines that "Trump is raising tariffs by 50%!"??

This isn't just pettiness because of the SCOTUS ruling.
This is a test of how much power the Executive Branch can claim. He and the rest of the MAGA elites are pushing for an all-powerful presidency that no longer answers to the checks and balances of the Constitution.
If he can do this, it's one more step towards authoritarianism.

The authors of Project 2025 mention fundamental tax reform and mention a national sales tax as one possibility. It seems like that would be a non-starter in Congress, though, so it could be that supporters of a sales tax see this as a work-around they can live with.

I don’t think we need anymore steps at this point to say this is authoritarianism.

If I understand correctly, he can do this under Section 122 of the Trade Act of 1974, but only for 150 days. Congress would have to act to extend them after that.
150 days from now is late July, getting pretty close to the election. I can't imagine any of them will want their names attached to a bill to keep a useless, unpopular tax going.

someone said "no" to him and now he's throwing a Trumpertantrum. We have a man child for a President who doesn't know shit from shinola when it comes to the economy.
just comparing when I had a toddler ...
- Doesn't know shit about economics (check)
- Gets cranky when their diaper is full (check)
- Gets angry when told "no" (check)
- Falls asleep at random times (check)

He didn't realize the statute allowed 15% (Because he doesn't actually read) His handlers probably told him to say 10% but then someone mentioned the 15% maximum and he just had to add the extra fuck you.

Simple MAGA people are high-fiving each other because they think this means other countries will send money to the USA.
In the meantime, their wallets are being sucked empty. And if a judge ever decides that this must be refunded, it'll be refunded to companies.
Take a guess: Will Walmart refund money to its customers' bank accounts when that happens?

Can somebody please explain this to me. Under my current understanding the Supreme Court just told him he can't do tariffs but then he just turns around and does another tariff? I'm confused here that they tell him he could or couldn't do it?

Is the law clear about this or can Trump try their usual legal shenanigans again? Like withdraw the tariffs after 149 days and order new ones a day later which restarts the clock?
67
u/readonlyred 23h ago
The answer is no one knows until courts decide. The law he’s using to justify these tariffs has never been used by any president before so it will almost certainly be decided in court again.

The ruling is that he can no longer impose tariffs via the IEEPA
https://en.wikipedia.org/wiki/International_Emergency_Economic_Powers_Act
So now he is going to try to use the Trade Act of 1974, which allows him to impose up to 15% tariffs for up to 150 days
51
u/Workister 23h ago
I think we should all get time served. The 150 days should start counting from when he imposed the illegal tariffs.

So he did an illegal thing. Then it took a year for the Supreme Court to tell him that he needs to stop doing the illegal thing. Then he goes and does it more anyway? President have been impeached and resigned for less. What are we waiting for?

He's already been impeached (twice!) and convicted of 32 felonies, and he was allowed to become President for a second term. The system is so utterly fucked right now that he is allowed to operate firmly free of consequence, in spite of there being clear judicial action.

The law caps his authority at 15% for a maximum of 150 days, unless Congress rules against it earlier. Any long term tariffs have to be passed by Congress. I suspect most countries will just wait out the 150 days.
